Preserving mobile privacy - can your boss look at your text messages?

nokia_e90-img_1333The Associated Press has posted an interesting article this morning about mobile privacy, which seems to be a confusing area when it comes to the workplace.

On Wednesday, a federal court ruled that employers must have the workers permission for a warrant to see messages on an individual’s mobile device since the messages are not stored by the employer or housed by an outside party.

Employers can opt to create clearer language in their privacy policies for employees, including allowing access to text and email messages, but most of messages are of personal nature and it is not clear how to handle this in the age of mobile privacy.

“Mobile privacy is increasingly a political and legal battleground - it’s a very confusing regulatory landscape, there are no clear rules in the crazy quilt of the mobile communications systems,” Jeff Chester said, the founder of Center for Digital Democracy.
